TERMS OF SERVICE
1. Acceptance of Terms
By engaging the services of Hotel Growth Agency Pty Ltd ("HGA", "we", "our"), you agree to these Terms of Service. These terms apply to all proposals, agreements and services unless otherwise agreed in writing.
These terms are governed by the laws of Queensland, Australia.
2. Scope of Services
Services are defined in a written proposal, agreement or statement of work. Only services expressly outlined in that document are included.
Any additional work outside the agreed scope may incur additional fees and will require written approval.
3. Performance and Results
HGA implements strategies designed to improve direct revenue, booking performance and distribution efficiency.
However, we do not guarantee specific revenue outcomes, return on investment or performance metrics. Results may vary based on market conditions, competition, pricing strategy, operational factors and third party platform changes.
4. Client Responsibilities
The client agrees to:
• Provide timely access to booking engines, advertising accounts and required platforms
• Supply accurate information and approvals when requested
• Ensure internal alignment with reservations, revenue or management teams where applicable
Delays in access, approvals or cooperation may impact performance and timelines.
5. Fees and Payment
Fees are outlined in the agreed proposal or contract.
Unless otherwise stated:
• Invoices are payable within 14 days
• Late payments may result in suspension of services
• Ongoing services may require monthly advance payment
All fees are exclusive of GST unless stated otherwise.
6. Advertising Spend
Media spend paid to third party platforms such as Google or Meta is separate from HGA management fees unless specified in writing.
The client retains ownership of their advertising accounts unless otherwise agreed.
7. Intellectual Property
Unless otherwise agreed in writing:
• Advertising accounts remain the property of the client
• Strategic frameworks, methodologies and internal systems remain the intellectual property of HGA
• Creative assets developed for campaigns are licensed for client use during the engagement
Ownership of specific creative deliverables may be defined in the proposal.
8. Confidentiality
Both parties agree to maintain confidentiality regarding proprietary information shared during the engagement.
This includes revenue data, operational information and strategic documentation.
9. Limitation of Liability
To the maximum extent permitted under Australian law, HGA shall not be liable for indirect, incidental or consequential losses, including loss of profit, revenue or business opportunity arising from the use of our services.
Our total liability is limited to the amount paid for services during the preceding three months.
Nothing in these terms excludes rights under the Australian Consumer Law.
10. Termination
Either party may terminate services in accordance with the agreed contract.
Upon termination, outstanding fees remain payable and access to managed systems may be revoked where appropriate.

Hotel Growth Agency is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles.
